COVID-19 victims who contract the disease while working may be entitled to benefits.

The SC Workers Compensation Act provides for recovery of weekly benefits, medical care and treatment, and permanent disability benefits if caused by an injury, accident, or occupational disease.

Workers in essential areas such as health care and grocery stores are on the front lines. Proving an occupational disease arising out of and in the course of employment is challenging. SC law requires the disease is peculiar to the employment and caused by on-the-job hazards greater than those ordinarily incident to employment (Mohasco Corp. V. Rising, 387 S.E. 2nd 456, 1987).
