Recent win proves mesothelioma cases continue to help families

This past fall, the family of a man who contracted mesothelioma after being regularly exposed at work to an adhesive that contained asbestos won their case against Wyeth Holding Corporation, with an award around $800,000.

In Bagley vs. Wyeth Holding Company, Mr. Bagley’s family (representing his case since his death from the cancer in 2012) sued Wyeth, who had acquired the company American Cyanamid, which produced foam adhesives used in helicopter blades that Mr. Bagley helped produce as part of his job. According to the American Association for Justice:

The jury found for the plaintiffs on the strict liability and negligence claims. The jury also found that American Cyanamid failed to provide adequate warnings but that the failure was not a proximate cause of Bagley’s death. The jury awarded about $804,800, including $363,500 in noneconomic damages for pain and suffering and loss of enjoyment of life, $256,000 for loss of consortium, $149,000 for loss of earning capacity, and about $36,300 for medical and funeral expenses. A defense motion to set aside the verdict is pending.
